These Terms of Service ("Terms") apply to your use of ikalula.com and any purchase from Ikalula LLC ("Ikalula," "we," "us," or "our"). By using our website, placing an order, or signing up for our text messages, you agree to these Terms. If you do not agree, please do not use the site.

1. Using our website

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to give accurate information and not to use the site for any unlawful purpose, to interfere with its operation, or to infringe anyone's rights.

2. Products and pricing

We try to describe products and prices accurately. All prices are in U.S. dollars (USD). Colors and details may look slightly different on your screen. We may change prices, products, or availability at any time, and we may correct errors, including after an order is placed.

3. Orders and payment

Placing an order is an offer to buy. We may accept, limit, or cancel any order, for example if an item is unavailable, there is a pricing error, or we suspect fraud. If we cancel an order after you have paid, we will refund you. Payments are processed securely through our e-commerce platform and its payment processors.

4. Shipping

We currently ship to addresses in the United States. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when the order is delivered to the carrier.

5. Returns and refunds

Return and refund terms will be posted on our site before we begin selling.

6. Intellectual property

The content on this site, including text, images, logos, and designs, belongs to Ikalula or its licensors and may not be copied or used without our permission.

7. Disclaimers

The site and products are provided "as is" and "as available," to the fullest extent allowed by law. We do not promise that the site will always be available or error-free.

8. Limitation of liability

To the fullest extent allowed by law, Ikalula is not liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim related to a product or these Terms will not exceed the amount you paid for that product. Some states do not allow these limits, so they may not apply to you.

9. Indemnification

You agree to hold Ikalula harmless from claims arising from your misuse of the site or violation of these Terms.

10. SMS / Text Messaging Terms

These SMS Terms apply to the Ikalula order and support texts program.

  • What you will receive: transactional text messages only: order confirmations, shipping and delivery updates, and replies to your customer-support requests. We do not send marketing or promotional texts through this program.
  • How to join: you opt in by giving your mobile number and checking the consent box on our text sign-up page, or by texting us to request support. Texts are sent from (718) 977-5469.
  • Message frequency: message frequency varies based on your orders and support requests, up to 8 messages per month.
  • Cost: Message and data rates may apply. Check your mobile plan for details.
  • Opting out: reply STOP to any message to cancel. You will receive one final message confirming you have been unsubscribed, and you will receive no further texts unless you opt in again. You may also reply CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL.
  • Help: reply HELP to any message for help, or email hello@ikalula.com.
  • Not a condition of purchase: consent to receive text messages is not required to make a purchase.
  • Supported carriers: the program is available on major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, and most regional and prepaid carriers. Carrier support may change.
  • Carriers are not liable for delayed or undelivered messages.
  • Your number: you confirm that you are the account holder or authorized user of the mobile number you provide. If you change or give up your number, please reply STOP from that number first or contact us.
  • Privacy: your mobile number and text-messaging opt-in data are not shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, unless the law requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Continuing to use the site means you accept the updated Terms.
